TERMS OF SERVICE
Ujamaa Web is a DBA under Ujamaa Business Group LLC. Ronnie McCarrell provides all services rendered. I will always do my best to fulfill your needs and meet your expectations, but it’s important to have things written down so that I both know what’s what, who should do what and when, and what will happen if something goes wrong. You won’t find any complicated legal terms or long passages of unreadable text in these terms of service.
WHAT BOTH PARTIES AGREE TO
You have the authority to enter into this contract on behalf of yourself, your company, or your organization. You’ll give me the assets and information I need to complete the project. You’ll do this when I ask and provide the formats I ask for. You’ll review my work, provide feedback and approval promptly. You also agree to stick to the agreed-upon payment schedule. I have the experience and ability to deliver everything I’ve agreed with you and I will do it all in a professional and timely manner. I endeavor to meet every deadline that’s set and on top of that I will maintain the confidentiality of everything provided.
DESIGN SERVICES
I create responsive designs that adapt to the capabilities of many devices and screen sizes. To give you a better understanding of my designs, I use HTML and CSS predominantly. You will have plenty of opportunities to review my work and provide feedback. I will share a Dropbox repository with you to add all content you want to be displayed on your website. I have regular, possibly daily, contact by phone and email. If—at any stage—you change your mind about my services or aren’t happy with my work, you must pay me in half of the agreed upon price of my services for the time I’ve spent working with you. Then, I will agree to terminate this contract.
GRAPHICS AND PHOTOGRAPHS
You will supply graphic files in an editable, vector digital format including Adobe Illustrator (Ai) or EPS. You will provide high-resolution digital photographs. If your design requires stock images, I will supply them at no additional cost. If you request a specific stock photo, I will ask you to purchase them so that you will be licensed to use them.
CHANGES AND REVISIONS
My goal is to produce a marketable, functional, and dynamic product; therefore, you are not limited to the number of revisions. After the project is completed, I will still provide the following revisions at no additional cost: change in wording, and swapping photos or videos. Payment is required for website structural design changes requested after the project is completed.
TESTING
You understand that browser testing no longer means attempting to make a website look the same in browsers of different capabilities or on devices with different size screens. You agree it does mean ensuring someone’s experience of a design should be appropriate to the capabilities of their browser or device. I will test and work only in current versions of the major desktop browsers including those made by Apple (Safari), Google (Chrome), Microsoft (Edge), Mozilla Firefox and Tor Browser. I will not test in older versions unless agreed separately.
BACKUP
Websites that are hosted by Ujamaa Web are backed up daily. Clients who use their own hosting provider are not guaranteed daily backups.
SEARCH ENGINE Optimization (SEO)
All pictures, videos, and every webpage created has SEO integrated features. In addition, website backlinks are used toward SEO rankings. I will make every diligent effort to ensure your website has acceptable rankings.
HOSTING
Every website on the internet is stored on a server which requires 100% uptime. Website hosting is offered for every client, and payments can be made every 6 months or annually. Clients can also use their own chosen website hosting provider if requested and must provide the access credentials of their hosting provider to build their website. I am not liable for any latency, downtime, or backups for client’s who use their own hosting provider.
LEGAL STUFF AND NONSENSE
I carry out work following W3C standards of website design best practices and at the standard expected from qualified professionals with relevant experience. Your liability to me is limited only to the agreed price of the project. If any provision of this contract shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this contract and shall not affect the validity and enforceability of any remaining provisions.
INTELLECTUAL PROPERTY RIGHTS
You guarantee the written content you provide for your website is original, or that you have the rights to use it. If you provide stock photos for your website, you guarantee possession of a license to use stock images that are owned by photographers or have been purchased from stock libraries. You agree to protect me from any claim by owners of copyrighted material. I guarantee my work is original. You own all content uploaded to your website; furthermore, you have the rights to use these files for any purpose.
DISPLAYING I WORK
I love to show off, so I reserve the right to display any aspect of my work as long as doing so does not breach any confidentiality agreement. This may include sketches, work-in-progress designs, and the finished project of the website online, in magazine articles, or in books.
PAYMENT SCHEDULE
You understand how important it is to you pay your bills promptly. A separate contact will be provided for agreed upon payment schedules and dates for each project. Payment contracts are created based upon the needs of every client. An initial agreed upon payment is required to begin each website design project. Hosting fees will start after the project is completed.
